Carers Legislation - Consultation on Proposals is a consultation on proposed legislative measures to further support carers and young carers in Scotland.

This consultation sets out the proposals which aim to improve outcomes for carers and young carers across Scotland.

It seeks the views of carers, young carers, local authorities, health boards and the Third Sector on proposed legislative measures that will provide further support to carers, young carers and the people they care for.

The consultation closed 16 April 2014.

Key proposals

  • Carers assessment to be known as carer’s support plan
  • Remove the ‘substantial and regular’ test so more carers are eligible for support
  • Remove that part of the existing assessment process where the person being cared for requires local authority community care/children’s services
  • Local authorities to be required to offer carer’s support plan
  • Remove the wording in the existing assessment which considers the carer’s ability to provide care
  • Local authorities to inform carer of the time it will take to produce the carer’s support plan
  • Local authorities to be under a duty, backed by statutory guidance, to provide information and advice on the carer’s support plan and the Carer’s Rights Charter
  • To consider whether support for carers should be a power or a duty
  • To introduce statutory guidance on managing the stages of caring, including transitions from young to adult carers
  • To involve carers in the design of carer’s support
